Welcome to Sleepy Monkey Pty Ltd (ABN 24 675 049 046). Our Montessori-inspired floor beds and mattresses are
thoughtfully crafted for toddlers transitioning out of cots, providing them with a safe, comfortable, and accessible sleep
space.

Each Sleepy Monkey bed frame is made from untreated Australian hoop pine, a durable hardwood that is carefully
dressed to a smooth finish, ensuring a splinter-free, child-friendly surface. Designed with Australian cot standards in
mind for the space between the mattress and the side rails, our beds and mattresses offer custom comfort with slight size variations to meet your child’s needs.

These Terms and Conditions of Sale, along with our Privacy Policy and website Terms of Use, govern your use of our online shop and any product orders placed on our website.
By ordering from Sleepy Monkey, you confirm that you have read, understood, and agreed to these terms.

Terms of Sale

1. Purchasing Sleepy Monkey products
1.1 You may buy Sleepy Monkey products by navigating our website's catalogue and shopping cart.
1.2 To purchase products via our website, you must be at least 18 years of age. 
1.3 You confirm that you are at least 18 years of age and that all information you provide is accurate, complete,
and not misleading by placing an order.

2. Prices
2.1 All prices are in Australian dollars.
2.2 Prices include Australian Goods & Services Tax (GST).
2.3 GST will be applied to all purchases delivered within Australia regardless of where the Customer is located.
2.4 All prices are subject to change without notice.

3. Payment
3.1 The full payment for your order (including the product price and applicable delivery charges) will be
deducted from your chosen payment method upon completing your order.
3.2 We accept payment by Eway and Afterpay.
3.3 We do not retain or store credit card details.

4. Safety Disclaimer

General Safety and Intended Use
4.1 Age Suitability: Sleepy Monkey floor beds and mattresses are designed specifically for toddlers and young children transitioning out of cots. These products are not recommended for children under 18 months of age, and users must ensure that the floor bed is suitable for their child’s development and readiness.
4.2 Intended Use: Our floor beds are intended solely for indoor residential use by toddlers and young children for sleep purposes. Any use outside of this intended purpose, such as play or climbing, is not recommended
and could increase the risk of injury.

Material and Construction
4.3 Product Composition: The floor bed frame is made from untreated Australian hoop pine, which is a durable, non-toxic hardwood that has been smoothly dressed to prevent splinters.
4.4 Although every effort has been made to ensure safety, adult supervision is required when children first use
the bed.
4.5 Weight Limit: The floor bed is designed to support the weight of a single toddler or young child and a co-sleeping parent. Please note the weight restrictions of the mattresses you use.

Assembly and Maintenance
4.6 Assembly: The bed must be assembled according to the instructions provided. Improper assembly or modification of the product can lead to structural instability and potential injury.
4.7 Inspection: Regularly inspect the bed frame and mattress for any signs of wear, damage, or loose parts. If any damage is found upon receiving your bed, immediately discontinue use and contact Sleepy Monkey for repair or replacement options. 
4.8 Environment: Ensure the floor bed is placed on a stable, flat surface away from hazards such as cords, heaters, or small objects that could pose a choking risk.

Mould Prevention and Slat Maintenance
4.9 To maintain the longevity and hygiene of your Sleepy Monkey floor bed, it is important to take the following
preventative measures against mould:
a. Air Circulation: Ensure the slats are spaced evenly to promote adequate airflow beneath the mattress. This helps to reduce moisture buildup, a common cause of mould growth.
b. Regular Checks: Periodically inspect the slats for any signs of mould or mildew. Early detection
and cleaning can prevent damage and ensure the safety of the sleeping area.
c. Cleaning Protocol: If mould is detected, clean the slats using a mild detergent and a damp cloth.
Ensure the slats are completely dry before replacing the mattress.
d. Avoid Moisture Traps: Do not place the bed directly on damp surfaces or areas with poor
ventilation. Consider using a dehumidifier in humid environments to reduce the risk of mould.
e. Mattress Care: Rotate and air the mattress regularly to further promote ventilation and prevent

depends on several factors beyond our control, including but not limited to the location, environmental humidity, ventilation, and the mattress itself. Sleepy Monkey does not accept responsibility for mould growth under these circumstances. As such, we will not offer replacements or refunds for mattresses, bed frames, or
slats affected by mould.

Supervision and Sleep Safety
4.10 Safe Sleeping Environment: We recommend placing the bed in a sleep-safe environment, free from items that could pose suffocation, entrapment, or choking hazards. Position the bed with adequate space around it to allow safe access and exit.
4.11 Adult Supervision: Adult supervision is advised, especially when children are first introduced to the bed, as
they adjust to the transition from a cot. Children may attempt to climb or play on the bed, which could lead to falls or injury.
4.12 Transition Readiness: Each child is different; parents and guardians should assess if their child is developmentally ready to transition from a cot to a floor bed. Children should be able to independently navigate in and out of the bed safely.

RED NOSE Sleep Protocol
4.13 Sleepy Monkey encourages all parents and caregivers to follow Red Nose sleep safety guidelines to promote safe sleeping practices for toddlers.
4.14 Red Nose Australia is a leading authority in reducing sudden infant death and fatal sleeping accidents in young children. Their evidence-based advice aims to create a safe sleeping environment.
4.15 To align with these recommendations, we suggest the following:
a. Sleep Position: Always place children on their back to sleep, ensuring their face and head remain uncovered.
b. Sleep Surface: Use a firm, flat, and well-fitted mattress without soft toys, pillows, or loose bedding in the sleeping area.
c. Sleep Environment: Ensure the room is smoke-free and maintain a comfortable temperature. Avoid overheating your child with excessive layers or blankets.
d. Supervision: When transitioning to a floor bed, closely monitor your child, particularly in the initial
stages, to ensure they adjust safely to their new sleep environment.

Limitation of Liability
4.16 Liability Disclaimer: While every effort has been made to ensure that Sleepy Monkey products are fit for purpose, Sleepy Monkey Pty Ltd shall not be liable for any injury, loss, or
damage arising from misuse, failure to follow safety guidelines, or use inconsistent with the product’s intended purpose.
4.17 Compliance with Standards: This product has been designed to align with applicable Australian Standards for children’s furniture; however, compliance does not negate the need for proper use and
supervision by a responsible adult.

Product Warnings and Consumer Obligations
4.18 Important Warning: Sleepy Monkey floor beds are not a substitute for a cot with sides in cases where a
child is not yet developmentally ready for an open sleeping arrangement.
4.19 Only transition a child to a floor bed when they show signs of readiness.
4.20 Consumer Responsibility: As the purchaser, you are responsible for assessing whether this product is suitable for your child’s specific needs.
4.21 Ensure that all caregivers and household members are aware of the safety guidelines related to this product.

5. Shipping and Delivery

Dispatch Time Frames
5.1 Sleepy Monkey processes all orders within 48 hours of receipt of payment.
5.2 Once an order is processed, Sleepy Monkey dispatches it within 3-5 business days from the day of payment receipt.
5.3 The handling period may vary, for example, if we have a high volume of orders.
5.4 You acknowledge that we are not liable for any delay in the dispatch of your order.
Shipping details
5.5 You must enter the correct delivery address details at the time of ordering.
5.6 If your goods are returned because an incorrect address was provided, you will be required to pay shipping costs to the correct address before your item/s are released.
5.7 All purchased items are ready to ship when in stock and will be posted within a reasonable timeframe (unless otherwise specified).

Postage fees
5.8 Postage fees are calculated at checkout.
5.9 From time to time, we may offer free delivery on orders over a certain amount.
5.10 If your delivery is non-standard, we will contact you to discuss postage rates.
Shipping within Australia
5.11 All items are shipped via a third-party shipping service provider.
5.12 We use a combination of TNT, Team Global Express, Designer Transport and StarshipIt to deliver your
item/s.
5.13 Shipping fees are varying as our products are large and bulky.

Lost items
5.14 Once your order has been dispatched, you will receive a tracking code to monitor its progress.
5.15 If you are concerned that your order has been lost or misdelivered, please contact us as soon as possible so
that we can investigate.
5.16 While we’ll investigate your missing order, you understand that we make no representations of responsibility or liability for any lost or misdelivered order.
5.17 In the event of items lost or damaged in transit, you acknowledge that our liability is limited to the amount of any compensation we can recover from the delivery service provider, less our reasonable costs of investigating and applying for any compensation unless otherwise required by law.

6. Returns Policy

Important Notice
Sleepy Monkey values your satisfaction with our products. Therefore, the following conditions are strictly applied to
all returns and requests for refunds or exchanges.
6.1 If your item/s are damaged or defective on delivery, please contact us at info@sleepymonkey.com.au within fourteen (14) days from purchase to arrange a suitable remedy, such as return, exchange, or refund.

Faulty or Defective Items
6.2 Sleepy Monkey reserves the right to inspect and assess the condition of returned used merchandise before
processing a refund.
6.3 Strictly no returns for change of mind due to the nature of the furniture being already assembled unless
there is a defect.
6.4 Sleepy Monkey will endeavour to correct the defect and offer new parts when necessary.
6.5 Where the item is deemed to have a genuine manufacturer fault or defect, provided you notify Sleepy
Monkey within fourteen (14) days of the purchase via info@sleepymonkey.com.au with the following details:
● Full name
● Transaction number
● Description and photo of the faulty or damaged item(s)
6.4 Item/s as the subject of a refund request, once received by Sleepy Monkey, will be examined for faults or
defects.
6.5 Within 24 hours of receiving the items from us, you will receive a notification about whether we agree that
they are faulty or defective.
6.5 If Sleepy Monkey deems an item faulty, a replacement item will be shipped where possible (subject to stock
availability).
6.6 Refunds are reserved only for item/s that are defective or unrepairable.
6.7 Returns will be processed within five (5) business days from when the item arrives at the Sleepy Monkey
Office.
6.7 Please allow five (5) working days for your refund to be examined and approved.
Return of items
6.6 When applicable, please ensure that all returned item(s) are appropriately sealed and packaged to prevent
damage in transit.
6.7 You are responsible for any damage to return items during transit, and we cannot accept return item(s) that
arrive damaged.
6.8 Sleepy Monkey does not accept responsibility for the items you posted to us.
6.9 Please use a tracked parcel service with insurance.
6.10 Please ensure all requested information is contained within the parcel so we can confirm the Customer’s
identity.

Postage fee management
6.11 Sleepy Monkey will reimburse you for return postage for a faulty item or where we have made an error (e.g.
dispatching an incorrect item) using third-party shipping services.

Address for the return of items
6.12 Please seal and return your item using appropriate protective postage satchels and ensure you use the
Australia Post trackable label. Please post items to:

6.13 Please ensure all requested information is contained within the parcel so we can confirm the purchaser’s details.

Change of mind refunds

At Sleepy Monkey, we do not issue refunds for change of mind. We encourage you to carefully consider your purchase and contact us with any questions before placing your order.

6.8 A refund or return is not offered for a change of mind.
6.9 We do not provide refunds for circumstances that do not require a refund under the Australian Consumer Law.

7. Special offers
7.1 Sleepy Monkey may provide special offers from time to time.
7.2 At any time, we may terminate any special offer without advance notice.
7.3 If terminated, a special offer will continue to apply to products you ordered in good faith under these Terms
before the special offer was terminated.

8. Intellectual Property and Copyright
8.1 All material on this Site or otherwise delivered by Sleepy Monkey, including (but not limited to) all designs
and products (Our Content), is subject to copyright.
8.2 Modification of our Content for any other purpose is a violation of our copyright and other proprietary rights
and is strictly prohibited and may be a violation of the copyright of third parties.
8.3 You acknowledge that you do not acquire any ownership rights by using the Site or our content.
8.4 The artwork, designs, trademarks, logos, and service marks displayed on our Site are the registered or
unregistered trademarks of Sleepy Monkey and third parties from whom we have obtained appropriate
permissions for use.
8.5 The trademarks, whether registered or unregistered, may not be used in connection with any product or
service that does not belong to Sleepy Monkey, in any manner that is likely to cause confusion with
customers, or in any manner that disparages Sleepy Monkey.
8.6 Nothing on this Site should be construed as granting, by implication or otherwise, any license or right to use
any trademark without our express written permission.
8.7 You agree that damages may be an inadequate remedy to a breach of these Terms and acknowledge that
Sleepy Monkey will be entitled to seek injunctive relief if such steps are necessary to prevent violations of its
intellectual property rights.

9. Liability Disclaimer
9.1 When using our products, you understand and accept that your children are your responsibility at all times.
9.2 Therefore, you are responsible for any injury or illness from using our products, Sleepy Monkey is not liable
or responsible.

General
9.4 Our products come with guarantees that cannot be excluded under the Australian Consumer Law.
9.5 You are entitled to a replacement or refund for a major failure and compensation for any other reasonably
foreseeable loss or damage.
9.6 You are also entitled to have the products replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.
9.7 You may also be entitled to remedies that cannot be excluded under the Australian Consumer Law if any services supplied by us to you fail to meet a consumer guarantee under the Australian Consumer Law.
9.8 To the extent legally permitted, Sleepy Monkey is not liable to you for any direct, indirect, incidental, special, exemplary, or consequential damages of any type related to or arising from the supply of products or services.
9.9 This exclusion and waiver of liability apply to all legal causes of action, including but not limited to contract, tort, or negligence.
9.10 Where we refund you the amount of your order as provided in your Agreement with us under this Terms of Sale (less any amount you have agreed we may deduct, as described in these terms and conditions), you accept such refund is the total amount of our liability to you for all circumstances relating to the refund.

10. Force Majeure (events outside our control)

10.1 A Force Majeure event is an event outside our control that delays or hinders our ability to perform our obligations under this Agreement.
10.2 A Force Majeure event includes but is not limited to fire, flood, earthquake or similar natural disasters, riot,
war, terrorism, civil strife, labour disputes or disturbances, industry-wide material or services shortages outside our reasonable control, an outbreak of pandemic disease, governmental regulations, communication, technology or utility failures, computer virus or unauthorised tampering.
10.3 Sleepy Monkey is obliged to reasonably mitigate the effect of a Force Majeure event to perform its obligations under this Agreement.
10.4 Sleepy Monkey shall not be deemed in breach of this Agreement for the suspension or delay in performing,
or failure to perform, any of its obligations under this Agreement if delay or failure of performance results from Force Majeure events.
10.5 Upon the occurrence of any Force Majeure Event, Sleepy Monkey shall notify the Customer of its inability to
perform or of delay in supply or delivery and shall propose the following at its discretion:
10.5.1 Revisions to the delivery schedule for products and services or
10.5.2 Cancel the order with a credit amount paid for the order minus any expenses without any
further liability to the Customer.

10.6 Where performance is impossible due to the duration and effect of the Force Majeure event, Sleepy Monkey
shall not be liable to the Customer for damages arising out of or relating to the suspension or termination of
any of its obligations or duties under this Agreement because of the occurrence of a Force Majeure Event.

11. Dispute resolution
11.1 Should a dispute arise regarding our service, we strongly encourage you to contact Sleepy Monkey at
info@sleepymonkey.com.au to seek a resolution.
11.2 Any reasonable requests will be considered. Sleepy Monkey will attempt to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

12. Alterations
12.1 We may alter these Terms from time to time by posting the modified version on our website.
12.2 You should visit the website regularly to keep updated with any alterations.
12.3 If the Terms are altered, they only apply to products ordered via the website after the modification takes effect.

13. Applicable law
13.1 These Terms shall be construed under and governed by the laws of the State of Queensland.
13.2 You consent to the exclusive jurisdiction of the courts of Queensland to determine any matter or dispute that
arises between you and Sleepy Monkey.
